Dashcam Video: Man Has Cardiac Arrest During Traffic Stop | Watch XFINITY Videos Online | News | Comcast not sure where to put this one
Nothing to do with the incident except that his comments and perceptions are now tainted I would say.
As a complete aside, I noticed that the gun he possessed was stolen in Michigan. Found its way to a guy who is apparently a rather common criminal.
So, commiting a crime precludes one from being able to speak truthfully about an unrelated event?
The video speaks for itself, obviously.
But how he might on the stand characterize whatever was going on before the video began, or his own perception of what was happening at the time, is going to have its issues.
So the prosecution doesn't call him, or if so they only ask him "were you the one videoing the event?". Don't open him up for the defense to tear his record apart.
In the criminal case that is certainly possible. But the defense could still ask him what was going on beforehand, and why was the man so agitated and confrontational, why was he waiving his arms around, why was he refusing to cooperate?
All true but if the prosecution does not delve into his account of the altercation, I doubt the judge would let the defense try to impeach his character.
My buddy got pulled over the other night, two other cop cars show up before the original officer finally goes up to his window. He says he has a headlight out. My friend is pretty damn sure he doesn't, but he didn't want to start anything. The cop goes back into his car for 45 minutes and comes back with a warning ticket. All the cops finally leave.
He checks both his headlights and they're working just fine. Takes a picture with them and the ticket.
Like. What even happened here? Cops/former cops have any insight as to why the cop was lying here?
