I would assume that they can get it rescheduled. I do not know if there is a case management order in effect that closes discovery at a certain time. My guess is that they timed it for the 25 because if Fulmer no-shows the Bama troopers could take him into custody for contempt at Jordan-Hare.

I would bet a continuation will be granted in light of the current football season and this will be taken care of after the season is over.

Ordinarily, this is something that is worked out between the lawyers but I am not sure that either party is going to want to play nice. Fulmer will want to quash the subpoena entirely and Smith will probably want to hold firm. It is my understanding that the case is filed in state court and i seriously doubt that an elected judge in Alabama is going to be very accomdating towards Fulmer. Even if you take the political element out of it, Smith's lawyers can always say (correctly) that Fulmer avoided the state for two years in an effort to evade service.
