3 die in Asheville Bar Stabbings--Interesting Case

3 die in West Asheville bar stabbings | The Asheville Citizen-Times | citizen-times.com

A guy gets kicked out of the bar, comes back and starts stabbing people, killing 2 and severely injuring another. The brother of one of the guys killed, along with several others from the bar, chase the killer and catch him as he is about to board a city bus. They fight and the brother ends up killing the killer. Now the brother is being charged with first degree murder. Is that right?

He should be charged. He was not defending himself. He chased the guy down and killed him.

I think you are right that he should be charged and I think it is appropriate to arrest him pending the outcome of the investigation. I don't think it is clear yet if he was defending himself or not.

I didn't read the article but you said he had multiple people from the bar that caught up to him. No way was it self defense in a 3 or 4 against 1.

Well if they caught up to him and he turned around and started swinging the knife and the brother turned it on him, then maybe. If the brother had his own knife that would be a different story.

i don't see how a person could chase someone then kill them and call it self defense. with that said that is what Zimmerman did and he has not been charged.

I can understand the brother frustration and trying to stop the killer. i would chase the killer down, i think that would be an automatic reaction.

it should be second degree murder because it's a heat of the moment type deal. i'm guessing they gave him first degree in hopes that he'll plea to manslaughter or something. there's no way he'd be convicted of first degree considering the circumstances.

Your life has to be in imminent danger in order to use deadly force. The brother that chased the guy down was putting the killer in imminent danger. He should be charged with 1st degree (I think?) murder.
