This is an old story but I didn't see any conversation on it. It was linked to by an article describing a similar case in Wisconsin and the outcry by the ACLU and many others.
Tennessee mom busted under new drug law after baby tests positive for meth - NY Daily News
I certainly think there should be an effort to protect these unborn children and their negligent parents should be held accountable. But I don't know if the application of this law is the best way to do it. Will this truly cause meth-addicted mothers to find ways to terminate their pregnancies early? A miscarriage won't land them in jail. Will they not go to the hospital to deliver the baby?
In this case, the woman avoided jail time by a plea deal and entered into a rehab program and was put on probation. Probably the best possibly outcome and a "sentence" that I think is probably the recommended one in cases like this.
